Non-Exclusive Photo Licensing (License) Agreement

Business Owners: This license can be used when you need to get rights from another party, typically a photographer, to use their photo(s).

Photographers:  This license can be used when you want to grant rights to another party to use your photographs without or without a fee.

This is for a Non-Exclusive License—which means the photos can be used by the photographer for other purposes including licensing them with other parties.

In other words, this agreement is a contract between two parties, the licensor (the photographer who owns the copyright and is licensing the rights to use the image) and the Licensee (the person or company wanting to and gaining the right to use the image).  This agreement can include, but is not required, payment by the Licensee (person/company wanting the right to use) for the license.  This is commonly called a License Fee.  This agreement can be for a limited time period (defined below as a “limited license”) or indefinitely (defined below as a “perpetual license”).  Make sure to indicate only one time period in the agreement.
